This Privacy Policy describes how OSM Solutions, LLC d/b/a Menuboard Manager (“we”, “us”, or “our”) collects, uses, and protects your personal information in connection with your use of our digital signage software and related services (“Services”).

Customer Business Data

Menu content, pricing, product and item information, images, and data received from a customer’s point-of-sale system are the business data of that customer and are not personal information. We use such data solely to provide the Services to that customer. We do not sell customer business data, do not disclose it to third parties except to service providers as necessary to operate the Services, and do not use it to develop, train, benchmark, or market products or services to others. Customer business data is also governed by the confidentiality terms of the applicable services agreement between us and that customer.

Information Sharing and Disclosure

We do not sell or rent your personal information. We share it only as follows:

  • Service Providers: We may share your personal information with third-party service providers who help us operate the Services, such as cloud storage providers and payment processors. These service providers are bound by contractual obligations to keep your information confidential and to use it only for the purposes authorized by us. A current list of our service providers is available on request.
  • Legal Requirements: We may disclose your personal information if we are required to do so by law, such as in response to a court order or subpoena.
  • Business Transfers: We may disclose your personal information in connection with a merger, acquisition, or other business transaction.

Where we have agreed to specific security obligations in a services agreement with a customer, those obligations apply in addition to this Policy and, in the event of any conflict, control.

Security Incident Notification

If we confirm a security incident that has resulted in the unauthorized acquisition of, or access to, personal information or customer business data that we hold, we will notify the affected customer without undue delay and in no event later than seventy-two (72) hours after confirmation. Our notice will describe what we know about the incident, the categories of information involved, and the steps we are taking in response.

Children’s Privacy

The Services are not intended for children under the age of 13. We do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian and you learn that your child has provided us with personal information, please contact us at operations@osmsolutions.com.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our website, and you are advised to review it periodically. Where this Policy has been attached to or incorporated into a written agreement with a customer, the version so attached governs that agreement until amended in writing, and we will provide that customer written notice of any material change.
